 The skeleton folks environmental policy was formed during an outburst of legislative activity during the 1960s and 1970s—the culmination of an environmental movement that had been gathering steam since the 1950s (Shabecoff, 2003). The legislation embodied many of the ideals of this movement, including an awareness of the necessity to limit man’s impact on the natural environment and protect what former USEPA Administrator William Ruckelshaus called the ‘essential unity of nature’ (Russell III, 1993). As flesh was added to the present skeleton by administrative implementation and judicial interpretation, political and economic realities narrowed the main target to protecting human health and, to a lesser extent, recreational opportunities (Russell III, 1993). As a result, regulatory efforts were directed almost exclusively at controlling the emission of pollutants from point sources (Adler, 2003; Stone, 2003). These pollution control efforts led to the planning and implementation of innovative policies, reductions in emissions from regulated sources and enhancements in various measures of ambient environmental quality (Adler, 2003; McKitrick, 2007). an interesting example of policy innovation is provided by the adoption within the Clean Air Act of 1990 (CAA) of a thought , first suggested in the 1960s (Crocker, 1966; Dales, 1968), of allowing pollution sources to buy and sell permits to emit pollutants.
